Why it matters

Employment and housing are key to reintegration and healthy communities. There are currently too many instances of commercial databases returning expunged, sealed, or obsolete records in search results. We need your help to provide a more adequate solution to misreporting and giving qualified individuals a fair shot at life.

The Fair Shot Pledge

I commit to support the fresh start of those who have had their records expunged.

Ideas on how to help individuals get a fair shot:

  • Use reliable background check providers to help ensure accuracy

    • Support accuracy by: update weekly (strict procedures)

  • Support “Ban the Box,” not running background checks until later in the hiring process

  • Use the Green Factors when a criminal history hit appears on a background check*

  • Inform applicants if they are removed from consideration due to a background check and allow them an opportunity to present proof of expungement to be placed back in consideration

  • Inform background check company of errors and demanding system correction/taking business elsewhere if you become aware of errors in their reporting

  • Support state contracts requiring background check companies to update records and remove expunged records from reports

  • Support accuracy requirements for background check companies in order to be approved in states where you have employees

    *The Green factors provide the starting point for analyzing how specific criminal conduct may be linked to particular positions. The three Green factors are:

    • The nature and gravity of the offense or conduct;

    • The time that has passed since the offense, conduct and/or completion of the sentence; and

    • The nature of the job held or sought.
